Design and Delivery of Arbitration Training for Panel Development in ADR

The consulting services include the following activities to be implemented over a 12-month period:

To design and deliver a Commercial Arbitration Training Course: A skills-focussed training course for a total of 24 participants to cover each stage of the arbitration process and review the procedures that arbitrators must follow to successfully complete an arbitration case. Participants are envisaged to be from varying professional backgrounds, both legal and commercial. The training should include an introduction to commercial arbitration and dispute resolution with topics including, but not limited to, the commercial arbitration framework; key issues relating to evidence; establishing the basis for arbitration and other forms of alternative dispute resolution; opening processes for formal arbitration; pre-hearing processes for formal hearings; arbitrability and jurisdiction; formal arbitration hearings; mediation and other ADR processes; powers of the courts; expert evidence; completion of hearings; and writing awards. Envisaged as an interactive training product, the course should include dynamic plenary and group discussions about core concepts and process; interactive discussions drawing on the existing experience and expertise of the participants; structured role-play simulations offering participants the opportunity to experience the roles of the arbitrators, the parties and their legal representatives; personalised coaching with feedback from highly skilled and experienced arbitration professionals; and references to “real” conflict situations and/or fishbowl activities, including min role-plays, video clips etc. Whereas some of the training may be offered online with structured tutorials and discussion board exercises, face-to-face workshops are also envisaged to include extensive role-play and arbitration exercises. Additionally, including reference to the Arbitration and Mediation Court of the Caribbean (AMCC)’s International and Non-International Arbitration Rules is requested to ensure relevance. The AMCC will work closely with the trainers to ensure the course structure encompasses the same. The training should lead to certification or accreditation, ideally by way of exams or assessments designed to test the participants’ knowledge and ability to practice as arbitrators to an internationally respected standard.
